The Refugee Rights Litigation Project is a project under Peace Way Foundation which has registered in Thailand. The project aims to develop legal services to urban refugees in Thailand.
General Statement of Duties
The Lawyer will provide counseling and legal assistance for refugees and represent refugees in judicial process as needed. The Lawyer will be responsible for creating a legal manual on litigating refugee-related issues and disseminating it among lawyer networks and law students. The candidate must be familiar with motion practice, litigation, trial preparation and have strong management and communication skills.
Responsibilities
- Provide legal advice and legal assistance to refugees, conduct pretrial activities, represent refugees in court and visit refugees in detention.
- Support in development of a litigation strategy to assist refugees in Thailand.
- Develop a litigation manual documenting best practices for refugee rights litigation.
- Disseminate the litigation manual with interested lawyers, through existing lawyer networks, main relevant legal agencies, and law schools, through a series of trainings.
- Develop and maintain relationships with partners and stakeholders, including government officials, academics, international agencies and civil society.
- Occasionally attend meetings and give presentations on refugee-related issues.
- Develop monthly reports on new laws, policies, practices and context related to the situation of refugees in Thailand.
- Contribute to project documentation including narrative and financial reporting. Provide administrative support. Draft memoranda, correspondence, letters and other documents based upon the project and as requested.
Other Conditions
- Availability to work outside of normal office hours, including weekends, holidays, and evenings as needed, including in dealing with urgent situations such as arrests.
- Commitment to work throughout the whole project period.
Requirements
- Thai nationality.
- Possession of a Lawyer’s License and eligibility to practice law before the courts.
- At least 5 years of litigation experience.
- Strong communication and data processing skills.
- Excellent interpersonal skills: energetic, perceptive, initiative, dedicated and accountable.
- Strong writing skills and careful attention to details. Ability to craft articulate, professional, and concise written materials and correspondence.
- Ability to work independently and collaboratively with colleagues and partners.
- Familiarity with electronic document management and filing systems.
Preferred qualifications
- Ability to communicate in English
- Experience working with vulnerable people
- Knowledge of laws and policies related to migrants, refugees, or stateless persons
- Knowledge of other languages
This position of the Litigation Lawyer starts at a gross monthly salary of 40,000 THB, with pay potential to 60,000 THB based on skills and experience. This is a contract position for 24 months with a tentative starting date of January 2, 2020. This position is based in Bangkok.

โครงการให้ความช่วยเหลือในการดำเนินคดีเพื่อสิทธิของผู้ลี้ภัย (Refugee Rights Litigation Project) เป็นโครงการที่อยู่ภายใต้มูลนิธิส่งเสริมสันติวิถีซึ่งจดทะเบียนในประเทศไทย โครงการมีจุดมุ่งหมายที่จะพัฒนาการให้ความช่วยเหลือทางกฎหมายแก่ผู้ลี้ภัยในเขตเมืองที่อาศัยอยู่ในประเทศไทย
ลักษณะงานทั่วไป
โครงการกำลังหาทนายความเข้ามาร่วมทีม เรามองหาทนายที่จะมาให้คำปรึกษาทางกฎหมายและให้ความช่วยเหลือทางกฎหมายแก่ผู้ลี้ภัยในเขตเมือง (urban refugees) รวมทั้งเป็นตัวแทนทางกฎหมายแก่ผู้ลี้ภัยในกระบวนการยุติธรรม นอกจากงานทางด้านการให้ความช่วยเหลือทางกฎหมายโดยตรงแล้ว ทนายในโครงการจะร่วมกันพัฒนาคู่มือกฎหมายสำหรับการดำเนินคดีที่เกี่ยวข้องกับประเด็นผู้ลี้ภัยเพื่อเผยแพร่แก่เครือข่ายนักกฎหมายและนักศึกษากฎหมายที่สนใจ เรามองหาคนที่คุ้นเคยกับกระบวนการยุติธรรม คุ้นเคยกับกระบวนการศาลและการทำงานกับศาล กับการยื่นคำร้อง การดำเนินคดี การเตรียมคดี และมีทักษะในการบริหารจัดการและการสื่อสารในระดับค่อนข้างดี
หน้าที่และความรับผิดชอบหลัก
- ให้คำปรึกษาและให้ความช่วยเหลือทางกฎหมายแก่ผู้ลี้ภัย ช่วยเหลือผู้ลี้ภัยตั้งแต่ตอนเริ่มถูกควบคุมตัว เป็นตัวแทนทางกฎหมายแก่ผู้ลี้ภัยในศาล เยี่ยมผู้ลี้ภัยที่ถูกกักตัวในสถานกักตัว
- ช่วยกันพัฒนายุทธศาสตร์ในการให้ความช่วยเหลือทางกฎหมายแก่ผู้ลี้ภัยในประเทศไทย
- พัฒนาคู่มือการดำเนินคดีที่ครอบคลุม best practice ต่างๆ ที่เกี่ยวข้องกับคดีผู้ลี้ภัย
- จัดอบรมเพื่อเผยแพร่คู่มือการดำเนินคดีแก่ทนายความที่สนใจผ่านทางเครือข่ายทนายความต่างๆ หน่วยงานทางกฎหมายที่เกี่ยวข้อง และสถาบันการศึกษา
- พัฒนาความสัมพันธ์กับองค์กรภาคีและผู้มีส่วนเกี่ยวข้อง รวมทั้งเจ้าหน้าที่ในหน่วยงานรัฐ นักวิชาการ องค์กรระหว่างประเทศ และภาคประชาสังคม
- เข้าร่วมการประชุมที่เกี่ยวข้องเพื่อนำเสนอประเด็นการทำงานในการให้ความช่วยเหลือทางกฎหมายแก่ผู้ลี้ภัย
- ทำบันทึกประจำเดือนเกี่ยวกับกฎหมาย นโยบาย แนวปฏิบัติ หรือบริบทใหม่ๆ ที่เกี่ยวข้องกับสถานการณ์ผู้ลี้ภัยในประเทศไทย
- ช่วยกันกับสมาชิกในทีมร่วมจัดทำรายงานโครงการ ช่วยงานธุรการ ทำบันทึก จดหมาย หรือเอกสารอื่นๆ ที่จำเป็น

- มีความยืดหยุ่นในเวลาทำงาน ในกรณีจำเป็นสามารถทำงานได้นอกเวลาทำการปกติรวมทั้งวันหยุดหรือในช่วงค่ำ และในกรณีฉุกเฉินที่จะต้องประสานงานเร่งด่วนเมื่อมีผู้ลี้ภัยถูกจับกุม

คุณสมบัติที่เรามองหา
- สัญชาติไทย
- มีใบอนุญาตว่าความและสามารถเป็นตัวแทนทางกฎหมายในชั้นศาลได้
- มีประสบการณ์การว่าความในศาลไม่น้อยกว่า 5 ปี
- มีทักษะในการสื่อสารและการประมวลข้อมูล
- มีมนุษยสัมพันธ์ดี มีความยืดหยุ่น กระตือรือร้น มีความเข้าอกเข้าใจ มีความคิดริเริ่ม สร้างสรรค์ ทุ่มเท และมีความรับผิดชอบ
- มีทักษะเขียนงานในระดับดี มีทักษะในการจดบันทึก ใส่ใจในรายละเอียดเล็กๆ และรอบคอบในการทำงานโดยเฉพาะงานเอกสาร ไม่นิ่งเฉยในเรื่องที่ตัวเองไม่เห็นด้วยและไม่กลัวที่จะแสดงความเห็น
- สามารถทำงานได้แบบ independent และในขณะเดียวกันก็ทำงานประสานกับเพื่อนร่วมทีมและองค์กรอื่นๆ ได้เป็นอย่างดี
- คุ้นเคยกับการบันทึกและจัดเก็บข้อมูลในระบบคอมพิวเตอร์
คุณสมบัติอื่นๆ ที่จะเป็นประโยชน์กับตำแหน่งงานนี้ (ไม่จำเป็นต้องมี)
- สามารถสื่อสารภาษาอังกฤษได้
- มีประสบการณ์การทำงานกับคนเปราะบาง
- มีความรู้กฎหมายหรือนโยบายเกี่ยวกับคนเคลื่อนย้าย ผู้ลี้ภัย หรือคนไร้รัฐ/ไร้สัญชาติ
- สามารถสื่อสารภาษาอื่นได้
ทนายความในตำแหน่งนี้จะได้รับค่าตอบแทนขั้นต่ำ 40,000 บาท และอาจเพิ่มได้ถึง 60,000 บาทขึ้นอยู่กับประสบการณ์การทำงานและคุณสมบัติต่างๆ ตำแหน่งนี้มีกำหนดระยะเวลาทำงาน 24 เดือน โดยจะเริ่มงานวันที่ 2 มกราคม 2563 สถานที่ปฏิบัติงานในกรุงเทพมหานคร
