Term of reference
The USAID Thailand Counter Trafficking in Persons Project is seeking a contract service to develop and create a short video that will explain the new data privacy protection law in Thailand, Thailand's Personal Data Protection Act BE 2562 (PDPA), along with any related laws to protect access to personal information and disclosure of personal data.
Background
In June 2021, Thailand’s new data privacy law – the Personal Data Protection Act BE 2562 (PDPA) - came into effect to regulate digital platforms and protect personal information of users from violators. This law has been introduced throughout digital platforms and applications. Meanwhile, as the regulatory environment for data privacy in Thailand sees development, the USAID Thailand CTIP Project has observed increasing data privacy concerns expressed by vulnerable groups and migrant communities in its project activities. Fear of the misuse and/or breach of their data, compounded with confusion over existing data privacy protection mechanisms, has also contributed to a reluctance to make use of digital platforms and tools, including those developed by CTIP organizations targeted for their use - tools such as those to raise grievances, assess their vulnerability, etc.
There is a need for disseminating knowledge on data privacy to ensure that vulnerable groups and migrant communities understand the law and their rights to privacy, data protection, and access to remedy in the event of a data breach. Thus, the video will enable users to understand their data privacy rights and the protection measures that they are entitled to access under Thai law.
Responsibilities
The contractor will be provided with an outline and key messages of the video content including concerns from Thai NGOs and beneficiaries over data privacy and the related laws. The contractor will be expected to lead the creative design process including scriptwriting, storyboarding, editing and final production of the video. The video will be produced in Thai, English, Burmese, Khmer, and Lao voice overs.
Objectives
The goal of this consultancy work is to produce a visually effective and high-quality video to address the data privacy concerns of NGOs, CSOs, and migrants. The video will explain to viewers their data privacy rights and measures that can protect their data and guarantee their privacy, with references to the PDPA and examples of Winrock’s applications that demonstrate the use of standard data privacy measures in action. The video can be a mix of infographics, and animation infographics and/or illustrations with no longer than five minutes duration.
Consultancy period: The production of the video will take place over a two-month period.
Deliverables and payment:
Payment will be made upon timely submission of satisfactory deliverables per agreed work plan, and approval by the contractor’s supervisor. The payment will be made in 3 tranches after all the deliverables have been met.
The payment schedule is subjected to negotiation between Winrock and selected Consultant.

Qualifications
Outstanding animations design and editing skills;
Experience as a video/animation creator with thorough technical knowledge (ability to operate, configure, set up and fix video, audio, lighting, or other production equipment. Must be familiar with the equipment and able to troubleshoot problems);
Experience in creating animations and infographics;
Experience in digital postproduction software to be able to edit raw footage, insert subtitles and closed captioning in compliance with Section 508, graphics, other on-screen text, and special effects into a video.
Proficient in English and Thai;
Experienced in producing public outreach activity videos/animations for non-profit organizations, especially with USAID as main funding entity;
Proven ability to work in multicultural environment with a professional work ethic, integrity and initiative;
Ability to work under pressure and meet tight deadlines;
Knowledge of trafficking in persons, data privacy, and/or private sector engagement is a plus.
