Title: Call for consultant to conduct a study on Divestiture under Competition Laws

Contract term: 90 days FTE or less, the study must be completed by September 2022

Location: Thailand

The Asia Foundation’s Thailand Office is seeking a qualified, talented consultant to conduct a study on Divestiture under Competition Laws. This study will be used to support the Office of Trade Competition Commission (OTCC).

Deliverables:

• Conduct a literature review on competition policies and regulations for Structural Remedy, focusing on Divestiture, in different jurisdictions/countries

• Review challenges and obstacles to the use of Divestiture in Thailand

• Analyze whether the current competition law in Thailand (The Trade Competition Act, B.E. 2560 (2017)) suffices to allow for the use of Divestiture as a Structural Remedy in order to maintain fair competition in the market

• Provide recommendations to develop Structural Remedy and Divestiture guidelines under the current competition law in Thailand. The recommendations must include proposals for amendment(s) to the current Thai competition law, the supportive and non-binding guidelines of legal interpretation and other ex-ante economic regulations

Requirements:

• At least 5 years of experience in competition laws and regulations.

• Master’s degree in law or economics. Doctoral degree preferable

• Has conducted a study related to market competition or competition laws
