Established in 1951, IOM is the leading inter-governmental organization in the field of migration and works closely with governmental, intergovernmental and non-governmental partners. IOM is dedicated to promoting humane and orderly migration for the benefit of all. It does so by providing services and advice to governments and migrants.
1. ORGANIZATIONAL CONTEXT AND SCOPE:
The Bali Process on People Smuggling, Trafficking in Persons, and Related Transnational Crime is a non-binding international, multilateral forum to facilitate cooperation and collaboration, information sharing and policy development in irregular migration in Asia-Pacific and beyond with 45 member States. The Bali Process Member States (BPMS) cover a wide geographic scope. Its membership has a diverse social economic conditions, legal system, and varying capacities to address, as well as respond to, the challenges posed by irregular migration, trafficking in persons (TIP), and people smuggling. BPMS, such as Myanmar and Syria, are in a state of protracted conflicts, while Pacific islands BPMS are experiencing natural disasters and other related phenomena that are drivers of irregular migration.
Among the challenges that confront BPMS is TIP. Asia Pacific is a bustling hub for TIP, every region in the world has detected a trafficked person from the region (UNODC, 2023). The United Nations Office of Drugs and Crime reported that in 2022 there was a significant decline in victim identification and criminal justice response to TIP.
The Regional Support Office (RSO) of the Bali Process was established to support and provide technical assistance to BPMS in the areas of policy development and operational capacity building for law enforcement and other duty bearers. The RSO endeavours to provide bespoke, contextually relevant, and responsive assistance to BPMS to address identified needs and gaps. Thus, to better understand the needs of BPMS, the RSO requires the services of an individual consultant to conduct an Assessment and Gap Analysis of the National Legal Frameworks and Policies on TIP and related laws, including regulations and rules on evidence.

The consultant will send the assessment tool to key stakeholders (relevant ministries, law enforcement, NGOs and civil society organizations engaged in counter-trafficking)
